Plusvalía, capital gains and other property taxes

Municipal plusvalía and capital-gains tax are separate taxes and both can apply to the same sale. The calculator estimates plusvalía, but not the seller's final capital-gains tax.

Municipal plusvalía (IIVTNU)

A town-hall tax connected to the increase in the value of the land during your ownership. It uses the cadastral land value, ownership period and municipal rules—not the value of the building. The seller normally pays. If there was no increase in land value, the tax may not be due, but evidence may be required.

Capital-gains tax

A national tax on the seller's taxable profit from the whole property. Broadly, the adjusted selling value is compared with the adjusted acquisition value, including qualifying costs and improvements. Individual Spanish tax residents generally face progressive savings rates of 19%–30%; non-residents generally pay 19%. Exemptions can apply in limited cases.

3% non-resident withholding

This is not an additional tax. When the seller is not Spanish tax-resident, the buyer normally withholds 3% of the selling price and pays it to the Spanish Tax Agency as an advance towards the seller's final tax. Any excess may be reclaimed; if the final tax is higher, the seller pays the difference.

IBI property tax

IBI is the annual municipal property-ownership tax, not a sale tax. The registered owner at the start of the year is generally liable to the municipality. In practice, the seller normally settles the bill for the year of sale, while buyer and seller may address allocation in the completion settlement.

Annual tax for non-resident owners

A non-resident owner may also have an IRNR obligation for rental income or imputed income for the part of the year before completion. This is separate from the tax on the sale and is not included in this calculator.

Buyer taxes—not seller taxes

On a resale, the buyer normally pays transfer tax (ITP). On a qualifying new-property purchase, the buyer normally pays IGIC and stamp duty (AJD). These should not normally be entered as seller costs.

Other selling costs—not taxes

Estate-agent fees and IGIC on those services, legal assistance, an energy certificate, mortgage cancellation, notary or registry work may apply. Enter known seller costs in the calculator.

This is general information, not a tax assessment. Confirm your position with a qualified adviser. Official guidance: municipal plusvalía legislation, selling a property, resident savings-tax rates and non-resident sale tax and withholding.

What you need

Find the figures before you begin

Your IBI receipt normally shows the total cadastral value and the portion attributable to the land. Your title deed records the acquisition date and value.

1 · Choose the municipality

The calculator is limited to Canary Islands municipalities.

2 · Enter deed values

Use the documented acquisition value and expected transfer price.

3 · Add IBI values

The land proportion is essential for both methods.

4 · Verify locally

Ask the relevant town hall or adviser to confirm the final assessment.

Methodology follows Article 107 of Spain's Local Treasury Law and the currently applicable national maximum coefficients. Municipal ordinances may use lower coefficients, a cadastral reduction or a lower tax rate. Official legislation.
